Terms of Service

1These terms

These terms govern your use of ClassMargin, operated by Toby Huntington-Whiteley, an individual trader established in France. By creating an account you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.

A company is being formed to take over the operation of ClassMargin. When it is registered we will notify you by email before it becomes the contracting party.

2What the service does

ClassMargin takes booking and payroll exports that you upload — from bsport, ClassPass, Wellpass and your own payroll files — and reconciles them into revenue, coach cost, margin and fill-rate figures, with recommendations drawn from them.

3The figures are calculated from what you upload

Every figure ClassMargin shows is derived from files you provide. If an export is incomplete, out of date, or covers a different period than you believe, the resulting figures will be wrong, and we have no way to detect that.

ClassMargin is a management reporting tool. It is not accounting software, and its output is not a substitute for your accounts, your tax filings or professional advice. Figures are labelled excluding VAT unless stated otherwise. You are responsible for checking anything you rely on, and for any decision you take on the basis of it.

4Your account

Keep your login credentials secure and tell us promptly at support@classmargin.com if you believe someone else has access. You are responsible for activity under your account.

5Subscription and payment

ClassMargin is billed monthly in advance through Stripe. Your price depends on how many locations your studio has. The price for each plan is shown on our pricing page; the plan you are on, and the locations it is counted from, are shown on your account page and on every invoice.

Every studio starts with a 30-day free trial, which requires no card. At the end of the trial your access is paused until you start a subscription; nothing is charged automatically and nothing renews unless you choose it.

If your number of locations changes, your plan changes with it from your next billing period, and we will tell you before it does. We will never charge you more part-way through a period you have already paid for.

You may cancel at any time; your subscription then runs to the end of the period you have paid for and does not renew. We do not refund part-periods except where the law requires it. If a payment fails we will tell you and may suspend access until it succeeds.

We may change our prices with at least 30 days' notice by email. A price change takes effect at your next renewal, and you may cancel before then.

6Your data, and other people's

Your data remains yours. We do not sell it, and we do not use one studio's data to produce figures for another.

You will upload files containing personal data about your coaches and your clients. In doing so you confirm that you are entitled to, and that you have given those people whatever information the law requires. For that data you are the controller and we are your processor — we act on your instructions, and our privacy policy explains what that means in practice.

7Acceptable use

Do not upload data you have no right to hold; attempt to access another studio's data; resell or white-label the service without our written agreement; or use it to build a competing product.

8Availability

We aim to keep ClassMargin available and to warn customers before planned maintenance, but we do not guarantee uninterrupted service. Parts of the service depend on providers we do not control — our host, our database provider, our email provider and our AI provider — and their outages will affect us.

9Liability

Nothing in these terms excludes liability that cannot be excluded by law. Subject to that, our total liability in any twelve-month period is limited to the amount you paid us in that period, and we are not liable for lost profits, lost revenue or business interruption.

10Ending the agreement

You may close your account at any time, from the Account page. We may suspend or close an account that breaches these terms, and will tell you why.

Closing your account deletes the studio and everything in it immediately and permanently. There is no grace period and no recovery. Download your export before you close it — the Account page will give you everything we hold, and once deletion has run we cannot get it back.

11Changes to these terms

We may update these terms and will email you at least 30 days before a material change takes effect. Continuing to use the service afterwards means accepting the new version.

12Governing law

These terms are governed by French law, and the courts of Paris have exclusive jurisdiction, subject to any protection the law gives consumers.
